Messaging Terms
These terms govern Blevins Holdings text-message and mobile-messaging programs, including enrollment, consent, message frequency, carrier charges, opt-out rights, privacy, security, and support.
1. Program Description
These Messaging Terms govern SMS, MMS, RCS, and similar mobile-message programs operated by or for Blevins Holdings LLC, including programs identified as “Blevins Holdings Notifications” or another name disclosed at enrollment.
Programs may provide account alerts, authentication messages, service notifications, administrative notices, support communications, event information, transaction updates, security alerts, relationship-management communications, or marketing messages when marketing consent has been separately obtained.
2. Acceptance and Eligibility
By enrolling in a messaging program, you agree to these Messaging Terms, the applicable enrollment disclosure, the Privacy Policy, and any service-specific terms presented at enrollment.
You must be at least eighteen (18) years old, be the subscriber or customary user of the number, and have authority to provide consent for that number. If you enroll on behalf of an organization, you represent that you are authorized to receive messages related to that organization.
3. Consent to Messages
Where required, you provide prior express consent or prior express written consent to receive recurring messages using automated technology at the number you provide. Your consent applies only to the program, message categories, and sender identified in the enrollment disclosure.
Consent to marketing messages is not a condition of purchasing goods or services. Transactional, security, account, or service messages may be necessary to provide a requested service, but you may still revoke consent as provided below, subject to consequences disclosed for the service.
4. Message Frequency and Charges
Message frequency varies based on your relationship, activity, preferences, and the program involved. Blevins does not charge a separate fee to receive program messages, but message and data rates or other carrier charges may apply under your wireless plan.
Check with your wireless carrier regarding your plan. Messages may be sent even if your number is listed on a state or federal do-not-call registry when the messages are permitted by law and within the scope of your consent.
5. Opt-Out and Revocation of Consent
You may revoke consent at any time using a reasonable method that clearly communicates your request. For messages that support replies, reply with any of the following words:
STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE.
You may also email sms@blevinsholdings.com or use another revocation method identified in the message or enrollment disclosure. We will honor valid revocation requests within a reasonable time not exceeding ten (10) business days, and often sooner.
We may send one nonmarketing confirmation message acknowledging your opt-out. If you are enrolled in multiple message categories, the confirmation may ask whether you intended to stop all categories. Unless you clarify otherwise, we may treat a broad revocation as applying to all consent-based automated messages from the identified sender.
6. Help and Support

Support may require identity or account verification. Do not send passwords, financial account credentials, protected health information, classified information, controlled information, or other sensitive material by text.
7. Delivery, Carriers, and Availability
Message delivery is subject to wireless-carrier networks, device compatibility, service availability, internet connectivity, number status, and other factors outside Blevins control. Messages may be delayed, blocked, duplicated, or not delivered.
Wireless carriers are not liable for delayed or undelivered messages. Not all programs are available on all carriers, devices, or in all locations. Blevins may change providers, short codes, long codes, toll-free numbers, or messaging technologies.
8. Telephone Number Changes and Reassignment
You must promptly opt out and update your information before discontinuing, transferring, or reassigning a number. You represent that you will not enroll a number belonging to another person without authorization.
If we learn that a number has been reassigned, is invalid, or is no longer associated with you, we may stop messages, remove the number, or require renewed consent.
9. Privacy and Messaging Records
We may collect and retain your telephone number, enrollment source, consent language, date and time of consent, IP address or device information, message content, message status, opt-out records, support interactions, and related compliance records.
We use this information to deliver messages, authenticate users, provide support, manage preferences, prevent fraud, document consent and revocation, comply with law, and protect our systems and rights. We may disclose messaging data to communications providers, hosting providers, security vendors, professional advisors, affiliates, and authorities as described in the Privacy Policy.
We do not sell your telephone number or messaging consent for money, and we do not share your consent with unrelated third parties for their independent marketing.
10. Security and Prohibited Content
Text messaging is not a secure channel. Do not use messaging programs to submit restricted, classified, export-controlled, controlled unclassified, protected-health, payment-card, proprietary, privileged, or other sensitive information unless a specific approved process expressly permits it.
You may not use a program to transmit unlawful, fraudulent, abusive, threatening, infringing, malicious, or unauthorized content, interfere with program operation, impersonate another person, or attempt unauthorized access.
11. Program Changes, Suspension, and Termination
Blevins may modify, suspend, or terminate a messaging program, number, message category, or participant’s access at any time, including for legal, security, operational, carrier, vendor, or risk-management reasons.
Termination of a program does not affect rights or obligations that accrued before termination or provisions intended to survive, including privacy, records, disclaimers, liability, and dispute provisions.
12. Disclaimers and Liability
Messaging programs are provided on an “as is” and “as available” basis. Blevins does not guarantee uninterrupted, timely, accurate, or secure delivery.
To the maximum extent permitted by law, Blevins is not liable for carrier charges, delayed or failed delivery, device incompatibility, unauthorized access caused by your failure to secure your device, or indirect or consequential damages arising from a messaging program. Applicable written agreements and nonwaivable law control where they provide otherwise.
13. Governing Terms and Disputes
These Messaging Terms supplement the Terms of Service. If a service-specific enrollment disclosure conflicts with these Messaging Terms, the more specific disclosure controls for that program. A signed agreement or mandatory law controls where applicable.
Disputes are governed by the dispute-resolution provisions in the applicable Terms of Service or controlling written agreement, including any arbitration and class-action waiver that validly applies.
14. Changes to These Messaging Terms
We may update these Messaging Terms. Material changes will be communicated through a reasonable method when required, which may include a message, account notice, email, or website notice. Continued participation after an effective update may constitute acceptance where permitted by law.
